TERMS AND CONDITIONS – ONLINE SHOPPING
Kindly ensure that you read through these terms and conditions as same applies to all purchases made online at http://www.danielas.co.za.
You are required to register with us before placing your first order online. Please click on Register to complete the registration form. Registration and/or use of our online shopping website constitute your acceptance and agreement to be bound by the Terms of our website and the following online shopping terms:
1. Online Registration
When purchasing goods online you will be required to register with a site called Payfast, which site is used to process all online payments made to Daniela’s Deliciously Decadent. When registering with Payfast, you will be required to provide certain information including personal details, payment card details and your delivery address. Our website will only require that you enter your delivery address.
2. Product Sales and Availability
All products displayed on our website are subject to availability and will be delivered only within the Republic of South Africa. All prices shown on our website are quoted in South African Rands and are valid and effective only in the Republic of South Africa. We reserve the right to discontinue or change the specifications of our products and services from time to time without notice. We will inform you as soon as possible if any products or services ordered by you are not available.
We have made every effort to display as accurately as possible the colours of the products that appear on our website. However, as the actual colours you see will depend on the device that you use to access our website, we cannot warrant that your device’s display of any colour will be accurate.
4. Content Errors
We regret that no order will be accepted if we identify a material error in the description of any of our goods or services or their prices on our website. Packaging may vary from that shown on our website.
5. Pricing Policy
You will be charged the prices as they are reflected on the website, subject to availability. Prices include Value-Added Tax. Special promotions may be subject to certain conditions, including stock availability and limited offer stipulations.
A delivery fee will be charged for each order placed.
6. Methods of Payment
Payment can be made in one of the following manners:
• Debit Card;
• Credit Card;
• Electronic Funds Transfer (EFT).
Should you choose to make payment via EFT, your order will only be dispatched once the funds have cleared in our bank account.
Credit and Debit Card payments are facilitated by Payfast (website: https://www.payfast.co.za/s/std/what-is-payfast)
When paying by Debit or Credit card, you will place your order on our site and then be directed to the Payfast site to finalise payment before being redirected to our site for final confirmation of your order.
7. Stock Availability
We cannot guarantee availability of stock but will endeavor to deliver a substitute line where possible. If we are unable to supply each and every item ordered or in the quantities ordered, you nevertheless agree to accept delivery and make payment for the items correctly delivered.
8. Confirmation of Orders
Orders placed online constitute your offer to purchase subject to these Terms and Conditions. Your offer is deemed to have been accepted by us when you receive our confirmation of your order. Failure by us to formally confirm or notify acceptance shall not affect the validity of the sale or the enforceability thereof.
Chef Selection Orders received by 11:00am will be delivered by 17:00pm on the following day. Deliveries will occur from Tuesdays to Fridays in all major city centres being Bloemfontein; Cape Town; Durban; East London; Johannesburg and Pretoria by our nationwide couriers via overnight express delivery.
Deliveries to any other areas may take up to 3 days from the date of dispatch.
Custom made orders require up to 5 days notice to process before dispatch. Please therefore ensure that your orders are placed timeously.
Orders required for a specific date may be placed up to 1 month in advance, with a minimum of 5 days notice.
Daniela’s does not deliver on Good Friday; 25th and 26th December or 1st January.
To assist our courier, please include the recipient’s cell phone number to ensure that orders are delivered on the first attempt.
As most of our orders are gifts we do not enclose invoices with deliveries. If you would like a tax invoice emailed to you, please request this in the additional information/comments section.
PLEASE NOTE Whereas we’ll do our best to ensure delivery of your macaroons at your preferred time and date in terms of flagging our parcels, instructing our couriers and following up on all tracking data; we however cannot guarantee prompt delivery at a specific time on a certain date as we rely on 3rd Party couriers for our deliveries.
Please allow an additional day’s notice for processing at peak gifting periods, for example, Valentines Day; Mothers Day; Eid and Christmas.
For verification purposes, the person accepting delivery at the delivery address may be required to produce a form of identification. Any person other than yourself, who receives the products at the delivery address is presumed to be authorised to accept delivery on your behalf. Should no-one be in attendance at the time of delivery, the driver will keep the products and leave a notice at the delivery address to this effect. The driver will attempt to contact you to make new arrangements for delivery or collection. We reserve the right to charge an additional delivery fee should same be required. Our liability for failing to deliver the products timeously is limited to delivery being effected at a later agreed time at no additional charge. Please arrange that you or your authorised representative is available to accept your purchases at the delivery address and that appropriate access will be made available. On delivery, we will require you or your authorised representative to sign and print your or their name on a duplicate copy of the delivery note, to confirm receipt. We have outsourced all delivery and collection arrangements. Accordingly, we cannot, to the extent permitted by law, be liable for any damage suffered or loss incurred by reason of any acts or omissions of the deliverer, its directors, employees, sub-contractors, agents, representatives and/or affiliates.
We deliver to the recipient’s physical address (specified in the delivery address area), throughout South Africa. The cost per delivery is R 85.00 (including VAT) to a maximum of 5Kg’s. When an order is placed and the weight of which exceeds 5 Kg’s we will automatically contact you to discuss delivery costs and options.
Corporate orders will be looked at independently to offer the best cost price.
Orders for delivery to major centres accepted before 11h00 will be delivered the following business day. All other deliveries to remote areas will be delivered within 3 business days, provided the delivery details are correct.
Once your order has been accepted, if required, we will e-mail you a tracking number which will allow you to follow the progress of your gift box.
Delivery to hospitals, maternity wards, nursing homes, government buildings, etc. will be made to the relevant reception area.
10. Refunds and Returns Policy
Our product is perishable and we are thus unable to provide refunds or accept returns if the product arrived on time and is correct as per the order placed.
If however, the incorrect items were supplied we will be happy to provide you with a refund or replace the items.
Once the order has been dispatched, no cancellations will be accepted. As payments are processed through Payfast a 10% admin fee will be charged on any cancelled orders. If you cancel your payment, for any reason or if your payment card should cease to be valid, you will nevertheless be bound to pay the full admin fee on any cancellations.
12. Risk and Ownership
Risk in the products shall pass to you or your authorised representative on delivery. We will retain ownership in the products until full payment has been received.
